4. Orders and Payments

4.1 Orders:

  • All orders placed through our Site are subject to acceptance by us. We reserve the right to refuse or cancel any order for any reason, including product availability, errors in the description or price of the product, or errors in your order.

4.2 Pricing:

  • All prices are listed in Canadian Dollars (CAD) unless otherwise noted. Prices are subject to change without notice. We are not responsible for typographical errors regarding price or any other matter.

4.3 Payment:

  • We accept various forms of payment. By providing a payment method, you authorize us to charge the applicable fees to the payment method you choose. All payments must be received in full before products are shipped.

4.4 Taxes:

  • Prices do not include applicable taxes, duties, or other governmental fees. You are responsible for paying all such fees.

5. Shipping and Delivery

5.1 Shipping:

  • We currently only offer shipping within Edmonton. Shipping costs are calculated and displayed at checkout. Delivery times are estimates and not guaranteed.

5.2 Risk of Loss:

  • All items purchased from us are made pursuant to a shipment contract. The risk of loss and title for such items pass to you upon our delivery to the carrier.

6. Returns and Refunds

6.1 Final Sales:

  • All sales are final. We do not offer refunds or exchanges.

6.2 Chocolate Melting:

  • Chocolate is sensitive to weather conditions. We are not responsible for any chocolate melting during shipment.

6.3 Customer Responsibility:

  • It is the customer’s responsibility to pick up their orders on the date and time agreed upon. For deliveries, it is the customer's responsibility to be available to receive their order. We are not responsible for stolen packages or melted chocolate if the package is left outside.

7. Intellectual Property

All content on our Site, including but not limited to text, graphics, logos, images, and software, is the property of Chōki Chocolatier or its licensors and is protected by Canadian and international copyright, trademark, and other intellectual property laws. You may not use, reproduce, or distribute any content from our Site without our express written permission.

8. Limitation of Liability

To the maximum extent permitted by law, Chōki Chocolatier shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the Site or Services; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from our Site; (d) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Site by any third party; or (e) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available via the Site or Services.

These Terms shall be governed and construed in accordance with the laws of the Province of Alberta, Canada, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the provincial and federal courts located in Edmonton, Alberta, for any actions related to these Terms.
